Special Meeting
of the
Lee County Board of County Commissioners
was held on this date with the
following Commissioners present:
Cecil Pendergrass, Chairman
Ray Sandelli, Vice-Chairman
Brian Hamman
Absent
Franklin B. Mann
Kevin Ruane
The Chairman called the meeting to order at 5:10 p.m. followed by the Pledge of Allegiance.
PUBLIC HEARING – 5:00 PM
1. First Public Hearing:
Ordinance
Amending LDC Chapters 16, 33, 34 – Mobile Food Vendors
Item Summary:
Hold first public hearing on November 16, 2021 for requested amendments which will
provide for limited regulation of mobile food vending, including to define locations and provide
standards of operation while mitigating impacts to surrounding locations. The second public hearing will
be held on December 7, 2021, at 9:30 a.m. in the Commission Chambers.
County Attorney
: Assistant County Attorney Amanda Swindle approved and submitted the
Affidavit of
Publication
for entry into the record and summarized the request.
Public Comment:
The Chairman called for public comment and there was one (1) speaker.
Board Discussion:
County Attorney Richard Wm. Wesch touched on the comments and concerns of the
public speaker and if it pleased the Board, recommended continuing this matter to the December 7, 2021
meeting. Mr. Wesch stated that continuing the hearing would provide the Board the ability to discuss
and direct staff to investigate certain aspects of the ordinance such as the required distance from a food
service business and what type of vehicles constitute a mobile food vehicle. Commissioner Pendergrass
commented that while areas such as Sanibel Island and Fort Myers Beach are under the jurisdictions of
the their city government, areas such as Captiva and Boca Grande are under the governing body of the
Board, therefore it is in the Board’s best interest to protect established business’s that remain after food
vendors leave. Mr. Pendergrass directed the County Attorney’s office to look into the possibilities of a
100 foot and a 150 foot setback regulation for food trucks from established restaurants.
Vote:
Commissioner Mann moved approval of continuing this item to the December 7, 2021 9:30 AM meeting
of the Lee County Board of County Commissioners, seconded by Commissioner Ruane, called and carried.
The Chairman adjourned the meeting at 5:20 p.m.
