Community Development Senior Planner Alvin “Chip” Block reviewed the request stated that both Staff and Hearing
Examiner (HE) recommended approval, and there were no Participants of Record. Responding to Commissioner
Kiker’s question on the roads,
Mr. Block stated that the roads are all private roads and have not been developed
according to County standards that included a variance application in 2000 that allowed this property to be used for
commercial purposes and not having to upgrade to roadway system. The Chairman called for public comment;
however, no one came forward. Commissioner Manning moved approval, seconded by Commissioner Pendergrass,
called and carried.

REQUEST
Rezone 29.6± acres from Residential Single-Family (RS-1) to Mixed-Use
Planned Development (MPD) for a maximum of 285 dwelling units, including
108 bonus density and TDR units, and 100,000 square feet of floor area for
commercial uses. Maximum building height requested is 45 feet. This
development will connect to public potable water and sanitary sewer service. No
development blasting is requested.
Request to participate in
Lee County’s Bonus Density Program, per
Lee County
Land Development Code Section 34-1516(a) and/or to allow an increase in
density through the use of Transferable Development Rights (TDR) concurrent
with the proposed MPD zoning pursuant to LDC Chapter 2, Article IV, Section
2-141 to allow 108 Bonus Density and TDR Units on the subject property. The
resulting density for the site would be .6 dwelling units per acre.
LOCATION
The Property is located on the west side of U.S. 41 (South Tamiami Trail),
opposite the intersection of Estero Parkway with U.S. 41, Estero Planning
Community,
Lee County,

Immediately following the public comments of Participants of Record, Attorney Hartsell responded and addressed the
speaker’s concerns, issues and to Board questions on entrances, security, lights, character of the fence, and
jurisdiction, and asked the Board to approve the Hearing Examiner’s recommendation. Brief Board discussion ensued
with Attorney Jacob, Applicant’s Engineer
David Willems, and
Lee County Senior Planner
Tony Palermo responding
to Board questions.
Commissioner Manning moved approval to both the Rezoning and Bonus Density requests, and disapproved the
requested deviation, seconded by Commissioner Pendergrass, called and carried, with Commissioner Mann
dissenting.
