stations, a maximum of 321 multiple-family dwelling units with a maximum of 35
feet in building height for commercial uses and 65 in height for residential uses.
No development blasting is requested. Development will connect to public

Michael Yates representing the applicant stated that he did not have any presentation but would respond to
questions if any. Commissioner Manning moved approval, seconded by Commissioner Pendergrass, called and
carried, with Commissioner Mann absent.

including 34 Bonus Density Units. The maximum building height will be limited
to 45 feet. This project will be connected to central water and sanitary sewer. No
development blasting is requested.
Request to participate in Lee County's Bonus Density Housing Program under the
provisions of the Land Development Code §34-1518, Site-specific density bonus
(Option 1) for up to 34 Work Force Income housing units.

Community Development Senior Planner Alvin “Chip” Block reviewed the request, stated that Hearing
Examiner (HE) recommended approval of the rezoning from CPD to RPD (DCI2013-00019) with additional
and modified conditions and development regulations and denial of the affordable housing bonus density case,
REZ2015-00003. Staff does not agree with the Hearing Examiner’s findings and recommendation and

recommends that the Board of County Commissioners approve both cases with the attached staff conditions
provided during the Hearing Examiner Public Hearing supplemented by the Hearing Examiner’s additional
condition (Condition #22). There were five (5) Participants of Record. Representing the applicant, Attorney
Charles Basinait of Henderson, Franklin, Starnes & Holt Law Firm provided a detailed presentation of the case
with explanation of the
differences
(Copy on file) between Hearing Examiner (HEX) conditions if Bonus
Density were approved and Staff/Applicant Conditions. The Chairman called on the Participants of Record,
and the following individuals came forward:

Following brief Board discussion, Commissioner Manning moved approval of Staff and applicant’s
recommendation of DCI2013-00019 to include the Memorandum of October 5, 2015 with attachments from
Staff, seconded by Commissioner Kiker, called and carried, with Commissioner Mann absent. Commissioner
Manning moved approval of REZ2015-00003, seconded by Commissioner Kiker, called and carried, with
Commissioner Mann absent.

Rezone 2,960.03± acres from Agriculture District, AG-2 and Private Recreation
Facility Planned Development, PRFPD to Mixed Use Planned Development,
MPD to allow development of 1,000 dwelling units and 40,000 square feet of
commercial development. Maximum building height will be 35 feet. The project
will connect to central water and sanitary sewer service. Development blasting is
being requested. (Concurrent comprehensive plan amendment CPA 2014-00004).

Property is located at 12030 Alico Road, SE Lee County Planning Community,
Lee County, Florida.

the Hearing Examiner (HE) recommended approval with the Staff’s request that the Board of County
Commissioners in a
Memorandum
(Copy on file) adopting the language for Condition 27.f as follows: “Water
quality monitoring and reporting shall be continued in perpetuity”. There were ten (10) Participants of Record.
Attorney Charles Basinait of Henderson, Franklin, Starnes & Holt Law Firm representing the applicant stated
that he would respond to any question. The Chairman called on the Participants of Record and the following
individuals came forward:

Responding to Mr. Cangialosi, Attorney Basinait stated that he disagreed with his comments that density would
impact on some fashion saying that the Comprehensive Plan Amendment made the decision on density in terms
of how it is going to be set up; and on benefits, it clearly outweigh any impacts to any other individual sites.
Commissioner Manning moved approval of the Hearing Examiner and Staff recommendations to include the
Staff Memorandum of October 6, 2015, seconded by Commissioner Kiker, called and carried, with
Commissioner Mann absent.
