Executive Attorney/Client Session
of the Board of Lee County Commissioners, for the purpose
of settlement negotiations or strategies related to litigation currently pending in United States District Court,
Middle District of Florida, Fort Myers Division Case No. 2:14-CV-00121-JES-CM, Eileen Schuman, John
Brock & Susan Noe v. Lee County, was held on this date with the following Commissioners present:
Franklin B. Mann, Chairman
John E. Manning, Vice-Chairman
Cecil L Pendergrass
Larry Kiker
Brian Hamman
The Chairman called the meeting to order at 8:32 a.m.
Lee County Attorney Richard Wm Wesch approved, as to legal form and sufficiency, the
Affidavit
of Publication
for this item. Attorney Wesch briefly described the request. The Chairman announced that
the
Attorney/Client Closed Session
would be held in the East Room with the following persons in
attendance:
Commissioner John E. Manning
Commissioner Cecil L Pendergrass
Commissioner Larry Kiker
Commissioner Brian Hamman
Commissioner Franklin B. Mann
County Attorney Richard Wm. Wesch
Deputy County Attorney Andrea Fraser
Assistant County Attorney Mark A. Trank
County Manager Roger Desjarlais
Jennifer Budreau of Von Ahn Associate Court Reporting
The public portion of the meeting was then suspended to a closed session in the East Room. At
approximately 8:43 a.m., upon conclusion of the closed session, the meeting reconvened in the County
Commission Chambers with all Commissioners present. The Chairman advised that the Executive
Attorney/Client Session of this date was concluded, and Attorney Wesch stated that, if appropriate, he
respectfully requests a motion consistent with the discussion they had during the Attorney/Client session.
Commissioner Manning moved approval, seconded by Commissioner Hamman, called and carried.
The Chairman adjourned the meeting at 8:45 a.m.
