An
Executive Attorney/Client Session
of the Board of Lee County Commissioners, for the purpose of
settlement discussions in the county litigation case of
United States of America v. Lee County, Case No. 2:12-cv-67-
FtM-29SPC, Middle District of Florida,
was held on this date with the following Commissioners present:
Cecil L Pendergrass, Chairman
Larry Kiker, Vice Chairman
John E. Manning
Tammy Hall
Commissioner Mann was absent for the entire meeting.
The Chairman called the meeting to order at 10:00 a.m.
Acting County Attorney Andrea Fraser approved as to legal form and sufficiency, the Affidavit of
Publication regarding this item. The Chairman announced that the Attorney/Client Closed Session would be held in
the East Room, and that the following persons would be in attendance:
Commissioner Pendergrass
Commissioner Kiker
Commissioner Manning
Commissioner Hall
Commissioner Mann
Acting County Attorney Andrea Fraser
Mark Levitt
Interim County Manager Doug Meurer
Fort Myers Court Reporting representative Kim Westberry
The public portion of the meeting was then suspended to a closed session in the East Room. At approximately 10:33
a.m., upon conclusion of the closed session, the meeting reconvened in the County Commission chambers with all
Commissioners present except for Commissioner Mann. The Chairman advised that the Executive Attorney/Client
Session of this date was concluded, with Acting County Attorney Andrea Fraser requesting the Board to authorize the
office of County Attorney to proceed with the settlement agreement. Commissioner Manning moved approval,
seconded by Commissioner Hall, called and carried with Commissioner Mann absent. Commissioner Hall requested
that, with consensus of the Board, the County Manager have Human Resources give an overview of the relevant
process for new and existing employees at the next Management and Planning meeting. The motion was seconded by
Commissioner Kiker, called and carried with Commissioner Mann absent.
The Chairman adjourned the Session at 11:34 a.m.
